Permissions & Licence Rights


Creamer Media's Research Channel content (including content from the Research Channel website, newsletter, reports, circulars, alerts) is subject to copyright and, except as permitted by Creamer Media or provided under South African copyright law, may not be reproduced, copied, distributed or otherwise without used without the express permission of Creamer Media. Note also that Creamer Media may not be able to grant permission for the reproduction, copying or distribution of all the content it publishes. Specific content may have been reproduced by Creamer Media with the permission of another copyright holder. Always verify that Creamer Media is the rights holder before relying on the permissions granted below.


In this Terms of Service, a User refers to:

  • A student, member, personnel, faculty member, agent, official or employee of an institution that    holds a valid subscription to Research Channel; and
  • An individual who holds a valid personal subscription.

Subject to the terms and conditions detailed herein and the timeous payment of subscription fees applicable, Creamer Media grants to the User the following permissions and licensed rights:

  • Access to Research Channel content for the period of subscription;
  • Research Channel content may be downloaded, viewed and printed, as applicable, by the User provided that no trade mark, copyright or other proprietary notices contained in or appearing on such content are removed in whole or in part;
  • Users are entitled to distribute abstracts of the relevant Research Channel web content accessed or Research Channel newsletter content to the User's institution only subject to including an attribution as follows "Source: Creamer Media's Research Channel at www.researchchannel.co.za". The abstract shall be limited to the title of the "article" and an extract thereof not exceeding a paragraph.

All other rights are reserved and Users must seek Creamer Media's permission before making any other use of Research Channel content.

 

Institutional Subscription

 

The number of Users granted to an institution is determined by a subscribing institution's subscription with Creamer Media The subscribing institution shall not exceed the number the Users determined by the subscription.

 

Confidentiality

 

All Authorised Users shall keep their Research Channel web access account details, User name and password confidential and shall, as applicable, comply with the terms and conditions of use detailed herein. Notwithstanding the duty of confidentiality, a User of an institution may share his/her account details with another employee of the same institution only and in the case of a newsletter, distribute such newsletter, in whole or in part to another employee of the same institution only. In the instance of such third party access using the User’s account details, the subscribing institution in the case of institutional subscription and the User in the case of a personal subscription shall remain liable and responsible for compliance with this Terms of Service.

Unauthorised Uses of Research Channel Content

 

In subscribing to Research Channel, the User agrees, other than as permitted herein or under South African copyright law, not to:

  • distribute Research Channel content to any unauthorised third party;
  • allow copies of Research Channel content to be stored or accessed by any unauthorised third party;
  • make such content available in any other form or medium or create derivative works, in whole or in part, without the written permission of Creamer Media;
  • alter, amend, modify or change such content or otherwise breach Creamer Media’s moral rights;
  • reproduce or exploit any Research Channel content, in whole or in part, for commercial gain;

Creamer Media reserves the right to withdraw the User’s access and/or terminate the relevant subscription in the event of unauthorised use or violation of this Terms of Service.

Privacy

 

In respect of personal details supplied to Creamer Media, the supplier consents to Creamer Media’s maintaining, recording, holding and using such personal data in accordance with Creamer Media’s Privacy Policy.

Exclusions & Limitations Policy

 

Creamer Media does not make any warranties in respect of the Research Channel content including warranties of accuracy or completeness. Such content and any information or other material contained in it are made available strictly on the basis that the User accepts it on an 'as is' and 'as available' basis. Where reliance is placed on any content, this is at the User’s risk and the User accepts that all warranties, conditions and undertakings, express or implied, whether by common law, statute, trade usage, course of dealings or otherwise in respect of the content are excluded to the fullest extent permitted by law. The User agrees that Creamer Media excludes all liability to the fullest extent permitted by law, in respect of any loss or damage resulting or arising from any non-availability or use of the aforementioned content or of any other content linked to it, or from reliance on such content.

All links from the Research Channel content are provided for information and convenience only and Creamer Media has no control over and cannot therefore accept responsibility or liability for the content of any linked content. Creamer Media does not endorse any linked third party content.

Jurisdiction & Precedence

This Terms of Service shall be governed by and construed in accordance with South African law. Any dispute arising out of the accessing or use of the Research Channel content shall be subject to the jurisdiction of the South African courts. In the event of conflict of provisions, this Terms of Service takes precedence over all other agreements between the User and Creamer Media.
